A magistrate dropped Nick Kyrgios’ assault allegation after he pled guilty to shoving over his ex-girlfriend in 2021. The tennis player appeared in the ACT magistrates court on Friday, where his request to have the assault allegation dismissed on mental health grounds was denied.
However, magistrate Beth Campbell dismissed the allegation, stating that the gravity of the offense was “low-level” and that Kyrgios posed a minimal risk of reoffending. World No. 20 was accused of pushing down his ex-girlfriend Chiara Passari after an argument outside her residence in the inner-city Canberra district of Kingston on 10 January 2021.
Passari was standing at the door of an Uber, blocking Kyrgios from leaving, when he pushed her over, according to the court. He stood over her and said “seriously” as she lay on the ground. Passari complained of a shoulder ache and grazing on her knee.

Passari had instructed Kyrgios to “leave me the fuck alone” and to “just fuck off” as she requested him to get out of the car and calm down. Passari did not report the event until ten months later when the pair split after reuniting after the incident.
The maximum term for common assault is two years in prison. Kyrgios is recovering from arthroscopic knee surgery after withdrawing from the Australian Open due to an injury last month. The operation to clean up his lateral meniscus and remove a para labral went well and his manager said last week they “couldn’t have wished for a better result”.
Kyrgios later apologized publicly.
