To support Texas companies and save money, the Comptroller encourages all taxpayers to participate in the annual Tax-Free Weekend and save money on tax-free purchases of most clothes, footwear, school supplies, and backpacks sold for less than $100. Tax-free purchases can be made at a Texas store or from an online or catalog vendor licensed to conduct business in the state of Texas. Tax-free purchases can be made without providing a seller with an exemption certificate.

The sales tax holiday this year begins on Friday, August 5, and runs through Sunday, August 7 at midnight.

During the sales tax holiday, you are free from paying sales tax on qualified items only. Before or after the sales tax holiday, you can’t get a refund or a break on purchases.

Online Purchases and Telephone Orders

There are no restrictions on where or how you can purchase qualified items over the Christmas period. The item must be sold at the designated time. If you buy anything in a brick-and-mortar store, you can easily figure out the date of purchase; if you buy it online, it’s a little trickier. No matter how long it takes to supply an item, the buyer must have considered it during the period.

Purchases made on Sunday, August 7, 2022, at 5:00 p.m. EST for school supplies that will not be delivered until Friday, August 12, 2022, and arrive on Tuesday, August 16, 2022, will still be free from the excise tax in the following year. As long as you don’t resubmit payment until Monday, Aug. 8, 2022, the purchase will be taxed if the charge to your credit card is refused at 11:00 p.m. on Sunday, Aug. 7, 2022, by the payment processor.

Additional Charges Affect the Sales Price

Items are sold with the cost of delivery, shipping, handling, and transportation already included in the price.

It is essential to check the item’s total sales price because clothing, bags, and school supplies must be less than $100 to qualify for tax-free purchases.

In this example, if you buy a pair of pants for $95 and add a $10 shipping fee, you’ll pay $105. The overall cost of the jeans exceeds $100, so tax is charged on the entire $105 purchase.

Only the delivery charge for the exempt item is exempt if an invoice includes both exempt and taxable goods.

Any one of the products in the shipment can be held responsible for the entire delivery fee if it is a flat cost for each package and the charge is the same no matter how many items are included.

Sales Tax Holiday Refund Requests

During the sales tax holiday, if you pay sales tax on eligible purchases, you can request a refund from the seller. Customers can request refunds from the vendor or the Comptroller’s office by submitting Form 00-985, Assignment of the Right to Refund (PDF), which is provided by the seller.
